3. When do we collect your personal data?

  • When you make an enquiry regarding our services.

  • When you instruct us to act on your behalf.

  • When you contact us through any means with queries, complaints etc.

  • When you choose to complete any surveys that we send to you.

  • When you provide a testimonial.

  • When you complete any forms.

  • When you’ve given a third-party permission to share information with us that they hold about you.

  • We collect data from publicly available sources, such as Companies House. Also, when you have given your consent to share information or where the information is made public as a matter of law.

  • You may be introduced to us by companies recommending our claim services because they complement their own. We have no obligation to accept introductions from such companies, we do not receive or pay any fees for the receipt of your enquiry from a third-party and we act entirely separately from any company recommending our services.  

  • We might obtain your contact details from liquidators or firms that are selling or passing data that we believe may be relevant to us offering our services. We will always ensure that we write to you within 30 days of obtaining your data, directing you to this privacy policy and details of how to opt-out from us using your data. 


4. What sort of personal data do we collect?

  • Details of your name, address, age, contact details.

  • Details of your financial history.

  • Details of investments, specifically related to the claim.

  • Details of your interactions with us through telephone, email or in writing.

For example, we retain notes and telephone call recordings from our conversations with you, details of any complaints or comments you make, details of the relevant claim, web pages you visit and how and when you contact us.

 

  • Copies of documents you provide to prove your age or identity where the law requires this. (Including your passport and driver's licence). This will include details of your full name, address, date of birth and facial image. If you provide a passport, the data will also include your place of birth, gender and nationality.

  • Information gathered by the use of cookies in your web browser.

  • Bank account details (if you provide them) to process any due compensation.
     

5. How and why we use your personal data

We want to give you the best possible client experience. One way to achieve this is by understanding exactly who you are and combining this with the data we hold about you.

The data privacy law allows this as part of our legitimate interest in understanding our customers and providing you with the highest levels of service.

Remember, if you choose not to share your personal data with us, or refuse certain contact permissions, we might not be able to provide you with some of the services that you’ve asked for.

For example, if you ask us to delete your records prior to the completion of a claim, this may prevent us from reaching a satisfactory outcome. As a result, this will trigger the automatic cancellation of the agreement. Please beware that in this instance, cancellation fees will be charged as stated in our Terms of Engagement.

In order for us to represent your claim to the best of our abilities and build the strongest possible case against the relevant organisation, we require as much information around the circumstances at the time of your purchase as possible. This will include collecting all evidential documentation available, along with your own personal statement of events.

 

This information will then be collated and presented to the relevant organisation. We may also need to show this information to the relevant regulators or government bodies during routine audits or inspections, which may be carried out frequently on all regulated firms.

 

6. Data Sharing

During your claim, you may specifically ask us to gather supporting evidence available from third parties through a Data Subject Access Request (DSAR). In these circumstances, you will need to provide us with specific written consent, and we will need to share proof of your identity with the third party. This is in order for us to complete and process the DSAR on your behalf.

From time to time we outsource certain business functions, such as administration services, regulatory compliance support and legal services to provide you with the best possible service. All our outsourced providers are professional in their fields and have strict data processing procedures in place. 

 

7. Data Retention

Once a claim is concluded, we retain your records for a period of no longer than six years. We do this in case your information is required for any reason, following completion of the claim.

​

For example, if new evidence comes to light in support of your claim, you may be able to make an appeal and obtain further compensation.

During the time that we hold your records, we may contact you under a ‘legitimate interest’ basis if new developments occur that are likely to affect you. Particularly if the information we are providing to you will be of benefit.

 

Personal information to third parties may be disclosed if we sell all, or a section, of our business and/or assets to a third party.

Website Analytics with Google Analytics


This website utilises Google Analytics 4, a web analytics service provided by Google LLC, after obtaining user consent. The relevant controllers are Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, for users from the EU/EEA and Switzerland. Google Analytics 4 practices IP anonymisation by default, meaning your IP address is instantly shortened when interacting with this website. Only under rare circumstances will your full IP be transferred to a US-based Google server and shortened there. Google maintains that the IP transferred via Google Analytics will never be combined with other Google data. Google Analytics 4 only activates upon your approval via the cookie banner, and can be undone anytime through the cookie settings.

Data processed includes: usage data such as page views, website interaction, general location, and visit duration; and communication data like shortened IP addresses, user agent, language preference and screen resolution. The purpose of this data processing is for Google to evaluate your website use on behalf of the website operator, compile reports on activity and analyze site performance. This data processing is legal, based on your consent under Art. 6 para.1 p.1 lit. a GDPR and § 25 para. 1 p.1 TDDDG.

Google Ireland Limited, Google LLC and Alphabet Inc are the recipients of this data. Your website usage information is typically sent to a Google server in the U.S., an action legitimized by the European Commission's recent adequacy decision from July 10th, 2023, which recognizes Google LLC's certification under the EU-US Privacy Framework. In terms of data storage, any data linked to cookies is automatically deleted after a certain period of time, which is monthly for data that has reached its retention period, and a maximum of 2 years for Google Analytics cookies.

Spam Protection with Google reCAPTCHA


We have implemented Google reCAPTCHA in forms on our website to check whether the data entered in the forms comes from human visitors or from machines or automated programs, also known as “bots”. This tool automatically analyzes the behavior of website visitors as soon as they interact with the website using various information like IP address, length of stay, and mouse movements. The data processed includes usage data such as the website accessed, date and time of access, and mouse movements, as well as communication data like IP addresses, browser type, and operating system. This processing is targeted at website visitors and users of online services. The primary purpose of this processing is to prevent the misuse of our contact form, thereby enhancing security. The legal basis for this is our legitimate interest according to Art. 6 para. 1 p. 1 lit. f. GDPR. The data recipients include Google Ireland Ltd, based at Google Building Gordon House, Barrow St, Dublin 4, Ireland, (https://policies.google.com/privacy) and our website hosting provider. While your personal data is processed within the EU, the retention time for the processed data is determined by Google Ireland Limited.
